이혼에 대한 기독교 윤리적 고찰

Abstract

본 논문은 한국의 목회 현장에서 이혼의 문제를 여전히 악을 행하고 죄를 짓는 문제로 치부하는 풍토가 강함을 보고 정죄의 근거로 제시되는 다양한 사항들이 기독교 윤리적으로 옳은가 살펴보고 비판하는데 있다. 제1장 서론에서는 문제제기와 함께 연구방법을 설명하였다. 결혼과 이혼이 개인의 문제이면서도 사회의 문제가 되기에 어느 시대건 주요 관심사이지만 지금까지도 여전히 분명한 답변이 어려운 문제로 있음을 말하였다. 특별히, 하나님의 뜻을 찾아야 하는 기독교인들에게 이혼은 평생을 죄인으로 사느냐의 문제이기에 더욱 분명한 기독교윤리적 답변이 필요함을 문제로 제기하였다. 제2장에서 이혼의 문제를 논하기에 앞서 먼저 기독교 윤리가 무엇인지를 다뤘다. 일반적으로 기독교윤리라고 여겨지는 생각이 실제로는 기독교윤리와는 무관한 생각임을 얘기하려 했다. 이를 위해 일반윤리와 기독교윤리의 차이점을 다뤘는데, 기독교 윤리는 일반윤리와는 달리 하나님의 은혜 없이는 인간이 선을 행할 수 없는 존재임을 말하였다. 일반윤리는 인간의 선함을 인정하지만 기독교 윤리에 있어서 인간은 죄성을 지닌 인간으로서 하나님의 은혜 없이는 윤리적 행위가 불가능한 인간임을 말하려 했다. 제3장에서는 역사와 성서 속에 나타난 이혼의 전제인 결혼과 이혼을 다뤘다. 제2장에서 살펴본바와 같이 윤리의 문제가 인류의 타락으로 말미암아 발생하였고 그 영향력이 결혼제도에도 미쳐 결혼제도가 처음의 설립 의도대로 운영되고 있지 않음을 보이려 했다. 이혼제도에 대해서는 교회와 신학자들 사이에서 이혼에 대한 입장을 표명하기 위해 주로 인용되고 있는 성서의 구절들을 중심으로 하여 살펴보았다. 성서와 역사 속에 나타난 결혼제도는 결혼의 목적부터 이미 그릇되게 운영되어, 실제 결혼에 있어서도 지참금제도나 혹은 일부다처제 등의 원 취지와는 다른 결혼제도의 모습으로 나타났음을 살펴보았다. 그리고 성서에서 이혼제도는 이러한 그릇된 결혼제도의 운영결과에 따라 약자 보호적인 차원에서 시작되었음을 말하였다. 성서에 나타난 하나님과 이스라엘, 그리스도와 교회의 결혼은유는 보수적인 교회에서 실제적인 부부의 관계 모델로서 사용되어지고 있기에, 어떠한 의도로 성서에서 결혼은유를 사용하고자 했는지를 다뤘다. 결혼은유의 목적이 하나님과 이스라엘의 계약관계를 설명하기 위해서 사용되고 있음을 보였다. 이스라엘이 하나님과의 계약을 파기하자 하나님과 이스라엘의 이혼이 결혼은유를 통해 나타나고 있음을 말하였다. 신약성서에 나타난 결혼은유 또한 구약성서의 연장으로서 하나님의 구원에 대한 약속의 성취를 보이기 위한 은유로서 사용하고 있음을 말하였다. 제4장에서도 제3장과 마찬가지로 타락의 영향력 하에 있는 결혼과 이혼제도가 구교와 신교의 교회법에 어떻게 적용되고 있는지를 살펴보고자 했다. 구교와 신교에서 인간의 죄 성을 고려하여 혼인 무효나 이혼제도를 두고 있기는 하지만 여전히 이를 부인한채 결혼을 성사로 보거나 가정을 교회로서 보는 것이 남아있고, 성서에 대한 문자적 해석으로 이혼사유를 제한하고 있음을 비판하였다. 제5장에서는 이러한 완전하지 못한 결혼제도의 운영결과가 우리나라에서 어떻게 나타나고 있는지 실제적인 통계를 통해서 살펴보았다. 또한 불완전한 결혼제도에 대한 보완제도로서 이혼제도를 종교개혁시대의 개혁자들의 예를 들어 다뤘다. 마지막으로 이러한 타락으로 인해서 불완전한 결혼이 이혼으로 가지 않기 위해 가족구성원들이 어떠한 노력을 해야 하는지를 가정의 정의 차원에서 다뤘다.;With the presupposition that all aspects of man's being are corrupted from Adam and man has not the ability to will to do good, this thesis proposed that divorce is a complemented system from the human corruption. This thesis examined the difference between general ethics and Christian ethics. General ethics basically suppose that man is good and has the ability to do good by himself, while Christian ethics suppose that man is depraved and has not the ability to do good without God's grace. However, many Christians think that in all things they do right and do not recognize that a divorce can happen to Christians. They don't realize the enormous power of sin. Human in marriage has been polluted by sin. Thus, the original functions of marriage has been corrupted. Chapter three examined marriage and divorce in history and the Bible. As seen in chapter 2 ethical problems have been occurred by the Fall, in results, the original purpose of marriage has been twisted by the sin. The corruptions of marriage affected for marriage couples and brought divorces in human history as well as the Bible. The paper argued that the marriage metaphor in the Bible is not the model for real couple, but it shows the model for the covenant between God and Israel. God could divorce Israel if Israel would break the covenant with God, as couple could divorce if the partner in marriage broke the marriage laws of the Moses. The marriage metaphor is used for showing God's promise on the redemption that God would not desert Israel. Chapter four examined the laws on marriage and divorce, in both Protestant and Catholic church. The Catholic church believes that marriage is a sacrament, therefore, a divorce in marriage is very limited. Protestant church also very has limited divorce's cases by interpreting the Scriptures literally. Chapter five examined the statics of marriage and divorce in Korea. The paper dealt with the reformers who admitted that, because of sin, divorce was a complemented system for corrupted marriage. To protect couple in marriage, the paper dealt with the right relationship and justice of family.
