Abstract
이 논문은 기독교 윤리의 시각으로 본 “사랑과 정의”의 문제를 연구하였다. 개인윤리의 핵심이라고 할 수 있는 ‘사랑’이란 개념과 사회윤리의 바탕이 되는 ‘정의’라는 개념을 어떻게 이해하고 통합하느냐에 그 목적을 두고 있다. 사랑은 우리에게 삶의 고달픈 현실을 위로하며, ‘그래도 살만한 세상’이란 가치를 부여하도록 용기를 준다. 격려와 위로, 따뜻함이 주로 사랑을 이해하는 하나의 기호로 표현되는데, 한국말로 표현하자면 한마디로 “좋은 것”이 된다. 기독교의 사랑(Agape) 역시 이런 의미들을 담고 있다. 그리고 더 나아가서 용서, 헌신, 자기희생, 대속으로서의 죽음이란 개념까지 포함한다. 베풂을 입는(사랑을 받는) 입장에서는 더 할 것 없이 좋은 게 사랑이다. 그러나 이 좋은 사랑이 ‘폭력’과 ‘억압’이 될 때가 있다. 다시 말하자면 ‘사랑해야 한다’라는 당위와 교리(율법)의 틀 속에 갇혀서 사랑이 주는 본래의 의미를 상실하고, 일방적인 명령과 얽매임 속에 억지로 베풂을 강요당할 때가 그렇다. 그래서 사랑이 ‘사랑이 아닌 게’ 된다. 사랑의 자발적 의미를 깨닫지 못한 채 희생해야 하고 용서해야 한다는 명령은 폭력이 되고, 분노하게 만들며, 결과적으로 자아상실의 지경에까지 이르게 한다. 그래서 정의가 필요하다. 사랑이 본래의 사랑이 되게 하기 위한 환경적 요소로서 “정의”를 요청하는 것이다. 정의 개념은 항상 평등과 상호성의 관념들을 일깨워 왔다. 이는 사람들 사이의 관계를 적절하게 조정하며, 부당하게 억압받는 사람들을 제도를 통해 보호해 준다. 그래서 정의란 결국 정의로운 제도 문제로 간다. 그리고 서로 간에 사람답게 살 권리를 보장하는 환경을 만든다. 사람은 이기적이지만, 제도는 사람이 인간의 폭력성을 누르기 위해 사회 구성원의 합의로 만들어 놓은 구속 장치이므로 인간의 잠재된 폭력성을 견제할 수 있다. 사랑이라고 포장된 폭력으로부터 구원받을 수 있는 것이다. 그러나 정의는 본능이나 관념에서 저절로 나오지 않기 때문에 투쟁과 설득을 통해서 성취된다. 따라서 정의를 확립하기 위해 애쓰는 것은 투쟁을 위한 투쟁이 아닌, 우리가 서로 믿고 의지하며 살 수 있는 공동체를 만들기 위해서라는 신념이 있어야 한다. 정의의 바탕에는 사랑이 존재해야 한다. 그러므로 사랑과 정의의 문제를 상호보완적 관계로 재해석함으로써 그동안 개별적으로 연구되었던 개인윤리와 사회윤리의 통합의 길을 모색하여 부조리한 삶과 불완전한 제도의 한계를 극복하고자 한다. 기독교의 사랑은 본질적으로 아가페라고 할 수 있다. 인류에 대한 하나님의 사랑과 하나님에 대한 인간의 응답적인 사랑을 말한다. 이와 같은 사랑은 필연적으로 이웃에 대한 사랑으로 확대된다. 하지만 인간의 이기적인 본성과 사회 환경이 만들어 내는 구조악의 문제가 만만치 않다. 따라서 사회 구성원들의 노력, 곧 정의로운 사회를 추구하고자 하는 의지로 사회의 구조악을 해결해야 한다. 이런 의미에서 우리는 정의를 요청한다. 정의는 의지만으로 이루어지지 않는다. 정의는 자유와 평등의 법칙을 가지며, 힘의 균형의 구조를 요구한다. 조화와 질서를 이루는 힘은 정부의 강제적이며, 조직적 힘과 어떤 사회 상황 안에 있는 활력과 힘의 균형을 통해서 이루어진다. 단지 힘의 균형이 정의가 되는 것이 아니라, 힘의 균형이 지배와 노예화를 방지하는 한에서 정의의 원칙이 된다. 그리고 힘의 균형은 강제력에 대한 도덕적 인가(sanction), 정신, 사회적 필연성과 같은 요소에 의해 힘의 균형을 이룰 수 있다. 또한 정치 영역에서 정부에 불평등한 부의 분배, 부패한 권력에 대해서는 견제의 방법을 사용하여 균형을 이루도록 촉구한다. 그리고 시민에게 정부의 강력한 힘이 남용되는 것을 견제할 수 있도록 정치 영역에 비판적인 참여를 요구한다. 그리고 정당 간에 자기 당의 이익을 위하여 정국의 혼란을 초래하는 것, 다수당이 힘으로 불의를 행사하는 것을 방지하기 위하여 정당 간의 균형을 촉구한다. 그러므로 라인홀드 니버의 주장처럼 사회질서와 정의는 힘의 조직화와 균형을 통해 더 완전한 형제애로 접근하도록 노력해야 함을 강조한다. 그러나 우리는 정의가 단지 상식과 현상의 수준에서 다뤄진다면 정의의 이해를 그릇되게 이끌어 갈 위험성이 있다는 것 또한 경고한다. 정의란 존재론적 탐구와 관계가 없는 하나의 사회적 범주(範疇)가 아니라, 존재론을 가능케 하는 범주이기 때문이다. 따라서 우리는 폴 틸리히의 존재론적 관점에서 본 사랑과 정의를 살핌으로 궁극적으로 사랑과 정의가 하나라는 것을 강조하려 한다. 존재의 현실성으로 삶 또는 생명의 본질이 분리된 것을 다시 하나 되게 하는 추진력(존재의 힘)이 사랑이라면, 존재의 정의는 이 활동을 적합하게 하는 형식이다. 정의는 사랑에 내재하며, 사랑은 최고의 윤리적 규범이다. 폴 틸리히가 말하는 창조적 정의는 사랑(love)이며, 궁극적으로 사랑과 정의는 일치한다고 말한다. 서로 사랑하는 관계에 있는 사람들은 행위 하는 특성과 이를 받아들이는 특성을 모두 가지고 있다. 서로 사랑한다는 것은 하나님의 힘에 의해서 일어나는 존재의 한 흐름이다. 우리는 이러한 사랑이 잘못된 힘의 관계를 바르게 정정하고, 서로를 창조하고 해방하는 과정으로 이해해야 한다. 또한 우리는 사랑이라는 이름으로 어느 한 집단이 일방적으로 희생을 감수해야 하는 상황을 묵인하고 있는 것은 아닌지 경계하면서, 세상 사람들과 바른 관계를 추구하도록 노력해야함을 강조한다. 사랑이란 인간의 상호 의존성을 통해 창조적인 상호작용을 만족시킬 수 있는 가치가 되어야 하기 때문이다. 따라서 우리는 사랑과 정의의 이분법적 논리를 거부하며, 사랑할 수 있는 환경을 만드는데 힘쓰고자 함을 강조한다.;This thesis is about the problem of "love and justice" through the mirror of Christian morals. The purpose of studying is on how to understandand integrate the definitions of love, which can be the point of personal morals and the definitions of justice, which can be a basis on society morals. Love gives us hope to live in a harsh reality and to realize it still is worth living. Love can be understood by encouragement, consolation and warmness and it is called "good things" in a word in Korean. Love in Christianity, Agape, has all these meanings, too. Furthermore, it includes forgiveness, devotion, self-sacrifice and death in Redemption. As for people who receive love, there is nothing better than love. However, there are times when this good love becomes violence and oppression. In other words, there are times when we trap in the rules that we have to love one another. We are so engrossed in the rule that we forget the true meaning of love and we are possibly forced to love others through orders or restrictions. That’s when love becomes ‘no love’. Order that we should sacrifice and forgive others without understanding spontaneous reactions of love can make violence. Violence can make anger. At last it comes to loss of selfness. That’s why we need justice. We ask for justice which has a role of environmental ground where love can be truly fulfilled. The definition of justice always brings equality and mutual ideas. In another word, justice settles the relationships among people and protects the unfairly kept down people through a system. Therefore, justice makes a fair system in the world. It also provides an environment where people have rights to live like human being. People are selfish, yet a system is a device which is made by members of society to oppress the violence of people. Through a system, the innate violence of human being can be restrained. We can be rescued by violence wrapped in love. However, justice doesn’t come right after instinct or ideas, but rather can be achieved by struggle and persuasion. Therefore, the reason why we struggle to make firm on justice is not because to struggle, but because to have faith to make a community where we can trust and rely on one another. There must be love existed in the basis of justice. Here I am going to redefine the problems between love and justice as mutual complement, so that first, I want to investigatethe united way of individual morals and society morals which had been researched separatelytill now and second, I want to suggest ways to overcome unreasonable lives and limitation on incomplete system. The love of Christianity is essentially called Agape. It is the love of God toward human being and the love of human being toward God in return. This kind of love is necessarily broadened to the love of neighbors. However, we have to think about organizational problems that can be caused where selfish characteristic of human being is in society. The organizational problems in society have to be solved by efforts of members in society, that is by will we wish to pursue a righteous society. From this point, we ask for justice. Justice is realized not only by will. It has rules of freedom and equalization, asking for organization of balanced power. Therefore, justice which has power to make harmony and order is also realized by forceful and organizing power of government and balanced energy and power on any social problems. Justice doesn’t just come true by balanced power, but balanced power can be one of the principles of justice as long as it doesn’t have control and enslavement. The balanced power can be affected by moral sanction, mentality and necessities in society. Justice stimulates the politics to have balance in unequal distribution of wealth from the government and to use ways to restrict corrupted power. Justice makes people to participate actively in politics, so that they can prevent the government’s overuse of great power. Moreover, justice demands for equality among parties. This is in order to prevent from bringing disorder of political situations among parties and from using injustice out of power among majority parties. Therefore, I strongly suggest that just like Reinhold Niebuhr’s opinion, social order and justice should be approached to more complete ‘perfect affection’ through systematization and equality in power. However, it is possible to misunderstand justice if justice is treated lightly. This can be very dangerous. Justice is not one of social categories nothing to do with researching ontology. Justice is one of social categories that can make otology possible. Therefore, I am going to emphasize love and justice are eventually one as we look into them according to Paul Tillich’s ontological point of view. Love is has driving force to unify separated true nature of life due to reality in existence. Justice, on the other hand, makes this force work appropriately. Justice is existed in love and love is the best ethical norm. According to Paul Tillich, creative justice is love and love and justice ultimately correspond. People who love one another have both characteristics of loving and being loved. To love one another means one flow of existence by the power of God. This love should be understood as the procedure of making unjust relationships of power right and creating and releasing one another. We have to be careful not to close our eyes to one group’s making one sided sacrifice under the name of love. At the same time, we have to try to make right relationships with one another. Love, after all, should be worthy of satisfying creative mutual actions through depending one another. As a result, we refuse two separate logic of love and justice and do our best to make an environment where we can love.
